S.Africa's Exxaro sees FY profit down

JOHANNESBURG (Reuters) - South African diversified miner Exxaro Resources said on Friday it expects full-year earnings to drop by as much as 41 percent, worse than market expectations and sending its shares to a three-week low.

The company said it sees headline earnings per share, which exclude one-time items, to come in at between 1,261 and 1,443 cents a share, or 31 to 41 percent lower than the 2,098 cents achieved in the previous year.

A Reuters SmartEstimate had forecast a 28 percent drop in full-year earnings.

Exxaro said the drop in revenue resulting from the sale of its mineral sands and Rosh Pinah operations in mid-2012 led to the decline in headline earnings.

Exxaro shares were 2.2 percent lower at 170.19 rand at 1208GMT, compared to a 0.06 percent drop by Johannesburg's blue-chip index.

Following a Healthy Diet to Manage Type 2 Diabetes

Diabetes If you?ve been diagnosed with type 2 diabetes or are teetering on the brink, your doctor has no doubt counseled you to follow a healthy diet to maintain safe blood glucose levels. As a patient with adult-onset diabetes, however, chances are pretty good that not understanding the basics of a healthy diet is what got you here in the first place!

The key to healthy eating is to plan meals in advance and to always keep a supply of high fiber multi-grain snacks, fresh fruits and vegetables at the ready to avoid making poor choices when hunger strikes. Eating smaller meals and frequent healthy snacks will help you to maintain steady blood sugar levels throughout the day. Remember to eat before and after periods of exercise or exertion as you burn off more sugar and carbohydrates.

A well-balanced meal should include a lean protein like chicken or fish, a small portion of healthy starch or grain such as brown rice or beans, and a heaping portion of vegetables. Skip the fried foods and replace all fats and oils with olive oil as much as possible. Rich in antioxidants, vitamins and iron, olive oil contains mostly beneficial monounsaturated fat and has been shown to modestly increase HDL cholesterol without adversely affecting LDL cholesterol, and is considered a heart-healthy, diabetes-friendly fat.

Daily Portions of Meat and Fish

A recommended portion of meat is about the size of a deck of cards, and lean meats such as fish and poultry are the best bets. Cold-water fish like herring, salmon are rich in omega-3 fatty acids, which may reduce risk of cardiovascular disease. The American Heart Association recommends limiting meat consumption to no more than six ounces (two decks of cards) per day, i.e. one portion with lunch and one with dinner. Beans are also an excellent source of protein and contain no animal cholesterol unless prepared with some form of meat or lard. Foods to avoid are red meat, bacon, lard, processed foods, which may contain trans-fats and cholesterol, and high-fat dairy products such as whole milk and many types of cheese.

Healthy Fruits and Vegetables

While the term unhealthy fruits and vegetables would seem an oxymoron, there are a few fruits that are high in sugar and should be avoided such as grapes, watermelon, pineapple, apricots and raisins, which may cause unhealthy spikes in blood sugar levels.? Stick to fruits that are lower in sugar and high in antioxidants such as cranberries, raspberries, blueberries, blackberries, grapefruit, cantaloupe and cherries.? All vegetables are good choices, but keep in mind, the richer in color they are the higher the vitamin content they possess.

Starches to Eat and to Avoid

While starches are readily converted to blood glucose, they are nonetheless an important part of a healthy diet because they provide valuable minerals, vitamins and fiber.? However, gluten and grains contribute great to diabetes, so the ideal complex carbohydrates to eat are fresh fruits and vegetables and occasionally brown rice.? Avoid oats and corn.? Also avoid snacks like potato chips, candy bars and other packaged snacks that have no real dietary value anyhow.

Dairy Products and the Diabetes Diet

Dairy products provide an important source of calcium and high-quality protein as well as Vitamin D. The best choices for dairy products are skim or 1% milk, non-fat or light yogurt with no added sugar and fortified, unflavored soymilk for the lactose intolerant. When considering carbs, one cup of milk or yogurt is equal to one small piece of fruit or one slice of bread.

Managing type 2 diabetes doesn?t have to mean completely giving up your favorite foods, merely limiting them to very small, infrequent portions, and learning to embrace healthy, whole grains and foods that are low in fat and high in vitamins and antioxidants. A healthy diabetes diet is a healthy diet for life, and will result in increased energy, improved digestion and a host of added benefits for health and longevity along with healthy blood glucose levels!

Pro tennis player from Quebec arrested in Florida

Florida officials have arrested a professional tennis player for attempting to have sex with a 13-year-old girl.

Pierre-Ludovic Duclos-Lasnier of Quebec, Canada, was arrested Thursday. The 27-year-old was training in Bradenton.

An arrest report says a detective assumed the victim's identity and chatted with Duclos-Lasnier on the victim's cellphone.

The report by Manatee County officials says Duclos-Lasnier solicited the girl for sex and sent a photograph of his penis. He offered to meet the girl and was arrested at the meeting point.

He faces charges of using a computer to solicit a child to commit sex acts; two counts of transmission of harmful material to a minor; and attempted lewd and lascivious battery. He's being held at the Manatee County Jail without bail. It's unclear whether he has an attorney.

'Zero Dark Thirty' unofficially banned in Pakistan

People watch "Zero Dark Thirty" outside a computer shop in Abbottabad, Pakistan, the town where Osama bin Laden was found hiding when American special forces killed him in May 2011. The Academy Award-nominated film appears unlikely to be shown on the local big screen anytime soon.

ISLAMABAD, Pakistan ??Very Zero, Very Dark? reads one Pakistani film review.

?Zero IQ Thirty? another headline screams.

But just like Osama Bin Laden, the subject of the Oscar contender that recreates the most expensive manhunt in history, "Zero Dark Thirty" is not supposed to be in Pakistan.

The film has not been released, officially. Thus, there is no response, officially, from Pakistani government censors to Kathryn Bigelow's controversial depiction of Pakistan. Therefore, technically, no one in Pakistan is supposed to have ever seen the movie.?

But in reality, "Zero Dark Thirty" is being watched, noticed, slammed and unofficially banned, even while trending on Twitter.

Some of the backlash in the mainstream press here was balanced.

?Though sharp in its production and direction and largely accurate in depicting the events that led to the death of Osama Bin Laden,? wrote respected columnist, Nadeem Farooq Paracha, in Dawn newspaper. ?It went ballistic bad in depicting everyday life on the streets of Pakistan.?

Paracha says that the movie may be designed to embarrass Pakistan, its people, its military and even its distinct culture. ?Or it might be simply a victim of sloppy research, he mused.

The journalist lists what he believes are the films goofs: The Pakistanis sound like an Indianized Arabic speakers (they are not). They eat hummus (which Pakistanis largely don?t). A?character in the movie claims that nobody in Pakistan drives SUVs (people love their SUVs here).

Both Sen. John McCain and Senate Intelligence Chair Dianne Feinstein have complained to SONY Pictures that the film is 'factually inaccurate.' NBC's Andrea Mitchell reports.

But what triggered more questions about the movie's message and motive here was when the country?s major cinema players decided not to buy the film from international distributors.

?As a local distributor, there was no financial viability for me. The film was already widely available in the [pirated] DVD market,? said Mohsin Yaseen, general manager of Cinepax, the largest multiplex chain in Pakistan . ?But as a film buff, the movie was inaccurate about Pakistan. If you?re going to say something about a complicated part of the world, then you should say it right.?

But Nadeem Mandviwalla, chief executive of Mandviwalla Entertainment, who has been buying and distributing Hollywood blockbusters for three decades in Pakistan, played down the hype.

?This whole ?ban, ban, ban? bit is a scam. It?s an assumption and just pure hype that?s perfectly timed for Oscar season,? Mandviwalla said. ?There is no politics [regarding screening "Zero Dark Thirty"]. There are tons of movies that don?t make it here. It?s not a political decision the army or the ISI [Pakistan's intelligence agency] makes for us. We, as businessmen, make it. And it was bad business modeling to bring this movie to Pakistan.?

But on the ground, reality has matched the fiction featured in the 157-minute thriller. ?In Islamabad, the movie was widely available in local DVD stores until mid-January, offered with either the original cover art or a locally designed version featuring bin Laden and current al-Qaida chief Ayman al-Zawahri.

Things are different now.

?We were asked to stop selling the movie by some guys a couple of weeks after we started stocking it,? said an attendant at Illusions, a popular movie and music retailer in Islamabad?s upscale Jinnah Super arcade.

?There were four of them. Two stood outside, as if on guard, and two came inside and told us that 'Zero Dark Thirty' was banned,? said the man who asked not to be named because for his own security. ?They said they were from Aabpara [the local neighborhood that headquarters the ISI]. They asked us to send the DVDs back to the warehouse, and they took a few discs back for themselves.?

?They were very polite,? he added.

("Zero Dark Thirty" is distributed in some parts of the world by Universal Pictures, which is?owned by NBC Universal.)

Williams Lake mayor releases statement about union's tactics

Mayor Kerry Cook released a statement late Thursday, responding to the "union's tactics."

Her statement is in full here:

?For the first time, the unionized employees of the City of Williams Lake have chosen to go on strike. The mayor and council consider the action unfortunate and designed to inconvenience our citizens but respect our employees right to do so.

With the agreement of the City and the Union, the Labour Relations Board has issued an Essential Services Order which will protect services necessary to protect our citizens? health, safety and welfare during the strike. If necessary, the city will apply for amendments to the order.

Clearly our citizens will be inconvenienced. For example, with Spring Break on the horizon, the union?s actions have lead to the shutdown of all programmes at the Cariboo Memorial Centre. We regret this.

The mayor and council also regret that the union has chosen to undertake a campaign of personal insults and misinformation, attacking city management, our negotiators and the council.

We do not know if the union?s tactics are having the desired effect. We do know that the feedback the mayor and council have been receiving has been overwhelmingly positive.

With regard to our management staff who are working hard to maintain essential services and to the city?s negotiating committee, they are doing a remarkable job under very trying circumstances and are having to endure inexcusable personal insults from the union. Management and our negotiating committee have the full and unqualified support and confidence of the mayor and council.

Before engaging in these personal insults against people doing their job, the union should remember that at the end of this strike, we all have to work together again. Needless antagonism is uncalled for.

Unfortunately the union has chosen to publish untruths and misleading statements. We will publish bulletins as necessary to rebut the union?s falsehoods as necessary and they will appear on the City?s website.?

John Dube, International Operating Union of Engineers Local 882B service representative responded to the mayor's message late Thursday saying the union does not have to justify what it's putting out to the public.

"The union has been very truthful and open and welcomes the public to come and talk to our people to find out that what we're putting out there are the facts. The union does not have to prove itself and that it has not lied to the public."

It was the union that went to the city and said it would supply the operators to make sure the ice remained at the complex, Dube added.

"So it seems funny that when they say they are trying to do something for the public, their idea was to take the ice out. Their track record is lousy," Dube said. "They had to go to arbitration with the Cariboo Regional District [fire protection], they are trying to shove arbitration down our throats because they can't do what they are supposed to do, and it's us that are putting out mis-information?

"They haven't proven that we've put out one piece of misinformation."

6 underground nuclear tanks leaking

YAKIMA, Wash. (AP) ? Six underground tanks that hold a brew of radioactive and toxic waste at the nation's most contaminated nuclear site are leaking, federal and state officials said Friday.

Washington Gov. Jay Inslee said the leaking material poses no immediate risk to public safety or the environment because it would take a while ? perhaps years ? to reach groundwater.

But the leaking tanks raise new concerns about delays for emptying them and strike another blow to federal efforts to clean up south-central Washington's Hanford nuclear reservation, where successes often are overshadowed by delays, budget overruns and technological challenges.

Department of Energy spokeswoman Lindsey Geisler said there was no immediate health risk and said federal officials would work with Washington state to address the matter.

State officials just last week announced that one of Hanford's 177 underground tanks was leaking 150 to 300 gallons a year, posing a risk to groundwater and rivers. So far, nearby monitoring wells haven't detected higher radioactivity levels.

Inslee traveled to Washington, D.C., this week to discuss the problem with federal officials. He said Friday that he learned in meetings that six tanks are leaking waste.

"We received very disturbing news today," the governor said. "I think that we are going to have a course of new action and that will be vigorously pursued in the next several weeks."

The federal government built the Hanford facility at the height of World War II as part of the Manhattan Project to build the atomic bomb. The remote site produced plutonium for the bomb dropped on Nagasaki, Japan, and continued supporting the nation's nuclear weapons arsenal for years.

Today, it is the most contaminated nuclear site in the country, still surrounded by sagebrush but with Washington's Tri-Cities of Richland, Kennewick and Pasco several miles downriver.

Hanford's tanks hold some 53 million gallons of highly radioactive waste ? enough to fill dozens of Olympic-size swimming pools ? and many of those tanks are known to have leaked in the past. An estimated 1 million gallons of radioactive liquid already leaked there.

The tanks also are long past their intended 20-year life span ? raising concerns that even more tanks could be leaking ? though they were believed to have been stabilized in 2005.

Inslee said the falling waste levels in the six tanks were missed because only a narrow band of measurements was evaluated, rather than a wider band that would have shown the levels changing over time.

"It's like if you're trying to determine if climate change is happening, only looking at the data for today," he said. "Perhaps human error, the protocol did not call for it. But that's not the most important thing at the moment. The important thing now is to find and address the leakers."

There are legal, moral and ethical considerations to cleaning up the Hanford site at the national level, Inslee said, adding that he will continue to insist that the Energy Department completely clean up the site.

He also stressed the state would impose a "zero-tolerance" policy on radioactive waste leaking into the soil.

Cleanup is expected to last decades and cost billions of dollars.

The federal government already spends $2 billion each year on Hanford cleanup ? one-third of its entire budget for nuclear cleanup nationally. The Energy Department has said it expects funding levels to remain the same for the foreseeable future, but a new Energy Department report released this week includes annual budgets of as much as $3.5 billion during some years of the cleanup effort.

Much of that money goes toward construction of a plant to convert the underground waste into glasslike logs for safe, secure storage. The plant, last estimated at more than $12.3 billion, is billions of dollars over budget and behind schedule. It isn't expected to being operating until at least 2019.

Given those delays, the federal government will have to show that there is adequate storage for the waste in the meantime, Inslee said.

"We are not convinced of this," he said. "There will be a robust exchange of information in the coming weeks to get to the bottom of this."

Inslee and Oregon Gov. John Kitzhaber have championed building additional tanks to ensure safe storage of the waste until the plant is completed. Sen. Ron Wyden, D-Ore., said earlier this week that he shares their concerns about the integrity of the tanks but he wants more scientific information to determine it's the correct way to spend scarce money.

Tom Carpenter of Hanford Challenge, a Hanford watchdog group, said Friday it's disappointing that the Energy Department is not further along on the waste treatment plant and that there aren't new tanks to transfer waste into.

"None of these tanks would be acceptable for use today. They are all beyond their design life. None of them should be in service," he said. "And yet, they're holding two-thirds of the nation's high-level nuclear waste."

Wyden noted the nation's most contaminated nuclear site ? and the challenges associated with ridding it of its toxic legacy ? will be a subject of upcoming hearings and a higher priority in Washington, D.C.

Quantum dots that assemble themselves

Feb. 19, 2013 ? Scientists from the U.S. Department of Energy's National Renewable Energy Laboratory and other labs have demonstrated a process whereby quantum dots can self-assemble at optimal locations in nanowires, a breakthrough that could improve solar cells, quantum computing, and lighting devices.

A paper on the new technology, "Self-assembled Quantum Dots in a Nanowire System for Quantum Photonics," appears in the current issue of the scientific journal Nature Materials.

Quantum dots are tiny crystals of semiconductor a few billionths of a meter in diameter. At that size they exhibit beneficial behaviors of quantum physics such as forming electron-hole pairs and harvesting excess energy.

The scientists demonstrated how quantum dots can self-assemble at the apex of the gallium arsenide/aluminum gallium arsenide core/shell nanowire interface. Crucially, the quantum dots, besides being highly stable, can be positioned precisely relative to the nanowire's center. That precision, combined with the materials' ability to provide quantum confinement for both the electrons and the holes, makes the approach a potential game-changer.

Electrons and holes typically locate in the lowest energy position within the confines of high-energy materials in the nanostructures. But in the new demonstration, the electron and hole, overlapping in a near-ideal way, are confined in the quantum dot itself at high energy rather than located at the lowest energy states. In this case, that's the gallium-arsenide core. It's like hitting the bulls-eye rather than the periphery.

The quantum dots, as a result, are very bright, spectrally narrow and highly anti-bunched, displaying excellent optical properties even when they are located just a few nanometers from the surface -- a feature that even surprised the scientists.

"Some Swiss scientists announced that they had achieved this, but scientists at the conference had a hard time believing it," said NREL senior scientist Jun-Wei Luo, one of the co-authors of the study. Luo got to work constructing a quantum-dot-in-nanowire system using NREL's supercomputer and was able to demonstrate that despite the fact that the overall band edges are formed by the gallium Arsenide core, the thin aluminum-rich barriers provide quantum confinement both for the electrons and the holes inside the aluminum-poor quantum dot. That explains the origin of the highly unusual optical transitions.

Several practical applications are possible. The fact that stable quantum dots can be placed very close to the surface of the nanometers raises a huge potential for their use in detecting local electric and magnetic fields. The quantum dots also could be used to charge converters for better light-harvesting, as in the case of photovoltaic cells.

The biggest challenge to serious gaming on Facebook could be in the form of gamers.? A lot of people do not view Facebook as a serious gaming platform. Singer Emeli Sande wins big at predictable BRIT awards

LONDON (Reuters) - Scottish singer Emeli Sande won the coveted best album honor at the BRIT Awards on Wednesday for "Our Version of Events", confirming her status as favorite going into British pop's big night of the year.

The 25-year-old, who received a major boost by appearing at the Olympics opening and closing ceremonies last summer, also picked up the best British female artist on a night of few surprises in terms of winners and on-stage antics.

"I think I'm a very unlikely pop star," an emotional Sande told a packed O2 Arena in London on receiving the best album prize.

"This is an album I wrote because I didn't have the confidence to sing these things in person. This is a dream, really, so thank you for this year and thank you for this award. I'm so grateful."

Sande capped her success by performing a medley of "Clown" and "Next to Me" to close the ceremony, broadcast live on commercial channel ITV.

The other multiple winner was singer-songwriter Ben Howard, who picked up two of the dotted statuettes designed by Damien Hirst, for British breakthrough act and British male solo.

Among the most popular triumphs was that of Frank Ocean, American R&B star who beat acts including Bruce Springsteen and Jack White to land the international male solo artist prize.

"Before this year I didn't get me any trophies in my life and I'm definitely a long way from working fast food in New Orleans," he told the audience, referring to his humble upbringing before breaking into the musical mainstream.

Devon rockers Muse got the annual awards ceremony off to a rousing start with "Supremacy", complete with fireworks and a full orchestra standing on balconies behind them.

Justin Timberlake wore a tuxedo to perform "Mirrors", continuing his pop comeback ahead of the March release of "The 20/20 Experience", his first album since 2006.

Taylor Swift donned a white, floating gown for "I Knew You Were Trouble" before an instant change into a figure-hugging black outfit complete with skimpy shorts and knee-length boots.

STYLES BLUSHES

One Direction received one of the loudest screams of the night as they took to the stage to sing charity single "One Way Or Another", which has reached No. 1 in 60 countries, underlining their status as global stars.

In recognition of that international reach, they were honored with the BRITs global success award.

James Corden, the comedian hosting the ceremony, made joking reference to One Direction's Harry Styles and his highly public love life.

"Sharon Osbourne is here, Annie Lennox is here. Who have you got your eye on?" Corden asked.

Styles, seated along with his bandmates at a dinner table in a room packed with hundreds of other stars and industry bigwigs, smiled sheepishly and hid his face behind an awards program.

Robbie Williams, who has won a record-breaking 12 BRIT Awards as a solo artist, sang "Candy", and Mumford & Sons, winners of the British group award, performed "I Will Wait".

In the most hotly contested best album category, Sande had been up against Mumford & Sons for "Babel", Alt-J ("An Awesome Wave"), Paloma Faith ("Fall to Grace") and Plan B ("Ill Manors").

Sande's was Britain's best-selling album in 2012, but the ongoing slump in CD sales last year loomed over what should be a celebration of the vibrant state of the country's pop music scene.

According to official figures, overall British album sales fell 11.2 percent to 100.5 million in 2012, despite a rise of nearly 15 percent in digital album sales.

While digital downloads account for an increasing share of record label revenues, the bulk still comes from physical CDs, and the steady decline blamed on online piracy and a shift towards buying singles online is a major concern.

Adele added to her groaning trophy cabinet with the best single award for James Bond theme "Skyfall". She was in Los Angeles rehearsing for her performance at the Oscars ceremony on Sunday and so was unable to collect the trophy in person.

American singer Lana Del Rey scooped the international female award, while Coldplay pipped The Rolling Stones to the best live act prize.

Veteran rockers the Stones were shortlisted after returning to the stage for a short, sellout tour of London and the United States at the end of 2012 to mark 50 years in the business. The last time they were nominated for a BRIT was in 1996.

Movie about Bruce Lee?s most legendary fight is in the works

Bruce Lee obtained legendary status as a martial artist in part because of a 1965 fight in Oakland, Calif., against Chinese kung fu master Wong Jack Man. It was the last fight of Lee's career.

For nearly 50 years, there has been much speculation and heated debate about what occurred inside of that gym, as very few people witnessed it. But the upshot of the bout is that it helped to develop Lee's views on Jeet Kune Do, which is the forerunner of today's mixed martial arts.

On Tuesday, Deadline.com reported that a movie about the fight that will be called "Birth of the Dragon" will be produced by QED International and Groundswell Productions.

Groundswell CEO Michael London told Yahoo! Sports on Tuesday that the process of developing a screenplay has just begun.

It is not, however, designed to be a biography of Lee, who died in 1973, or the definitive account of the fight.

"We're actually not trying to re-tell the story of Bruce Lee," London said. "I think that's a natural impression people might get. The idea, actually, is to take that battle, which has been so mysterious and so powerful and so interesting to so many, and tell the lead-up to that story, which is Wong Jack Man's arrival in San Francisco.

"We've created a back story. There is a lot people that know about why Wong Jack Man came to San Francisco, but we're trying to create a dramatically satisfying story about why he's there. So we're taking license. That's why we say it's going to be inspired by that fight and isn't a literal telling of it."

London said the writers -- Christopher Wilkinson and Stephen Rivele -- have the belief that Jack Man was trying to help Lee to become the best version of himself and was trying to teach Lee lessons.

London said the fight sequences will be shown through the eyes of the people who were there. One of those was Lee's wife, Linda, who was eight months pregnant at the time with the couple's son, Brandon.

"There will be a slightly stylized quality to the actual fight sequences," London said. "That will allow different people who were there to come away with differing conclusions of what happened. ... The whole idea is that the 13 people who saw that fight came away with very differing ideas of what happened. The fight itself will be impressionistic."

Jack Man is reclusive and rarely does interviews and has rarely spoken of that fight. London said producers will approach him after finishing the screenplay. He said he hasn't reached out to Lee's family, either.

Lee's daughter, Shannon, who runs the Bruce Lee Foundation, said that the fight was significant in her father's life because of the impact it had upon him.

Cal coach Mike Montgomery has been reprimanded by the Pac-12 for shoving one of his own players during a game Sunday night.

The conference did not announce what specific punishment Montgomery received for his action, although the Associated Press said it would not include suspension.

Montgomery, who coaches the men's basketball team, gave star player Alan Crabbe a "shove" during a second-half timeout.

There is no proof of a connection, but the Bears were losing at the time.

After the timeout, the team made a come back, lead by Crabbe, and beat USC 76-68.?

"It worked, didn't it?" Montgomery said after the game.

Later he apologized after Sandy Barbour, the Cal athletic director, called the shove "unacceptable."

Montgomery said his "passion for the game" may have played a role.

California Sen. Leland Yee said the reprimand is not enough.? He wants Montgomery to be suspended for a game.

In a statement released Monday afternoon, Lee said the university should not tolerate that kind of behavior from our coaches.

"The game was an emotional one, but representatives of UC ? especially adults ? need to be able to control their emotions and refrain from physical altercations with students. I urge the university to take swift disciplinary action of at least a one-game suspension and I wish the Cal basketball program the very best as they enter the final games of the season,? Yee said in a statement.?

With 16:31 left in the second half, Crabbe, the Pac-12 conference's leading scorer, had 9 points. He scored 14 more after Montgomery "gave him a sharp push" and "yelled, 'Do you want to play?'"

George McDonald's strategy to become mayor is built on breaking the law ? the city?s campaign finance law.

McDonald, an advocate for the homeless, has taken 10 campaign contributions greater than the city?s $4,950 legal limit ? including one for $40,000. And his campaign has obtained a $120,000 loan in violation of city election law, too.

It?s all intentional, part of an unprecedented attack on the city?s tough election law ? one that could allow more money to pour into local races if it is successful.

McDonald says that the city?s limits on contributions are unconstitutional, and he?s filed a lawsuit asking a judge to invalidate the law.

?No one has knocked it down in 23 years,? said Hofstra Law School dean Eric Lane, who helped to write the law 23 years ago.

But there are fans of McDonald?s legal challenge.

Ironically, one of them is a rival for the Republican nomination for mayor. Sources close to Joe Lhota say his campaign hopes McDonald can invalidate the contribution limits. Such a victory would make it easier for Lhota to raise cash, too.

By flouting the law, the McDonald campaign could be fined $57,050 by the city Campaign Finance Board, a board official said.

But that penalty would be reduced to $4,463 if McDonald lost the court case and returned the excess contributions. McDonald would likely face no penalty if he won his legal challenge.

It?s a risk McDonald is willing to take.

Spokesman David Catalfamo said the city?s strict donation limit makes it impossible to go up against wealthy candidates who can spend as much of their own money as they want.

?George . . . wants to be the next mayor, and in order to do that, he needs the resources to compete,? Catalfamo said.

?The current system favors candidates who can self-finance, like Mike Bloomberg or (Gristedes owner) John Catsimatidis or career politicians who spent years building donor rolls.?

McDonald argues the city contribution limit is unconstitutional because state election law allows a donor to give up to $41,100 to a candidate in a general election.

The city?s contribution limit was instituted as part of a landmark program that gives $6 in city funds to every $1 donated by city residents to qualifying candidates, up to a maximum ?match? of $1,050 per donor.

The $4,950 donation limit was instituted in 1988 for candidates participating in the city?s matching funds program. In 2004, it was expanded to cover all donations.

Campaign Finance Board spokesman Matthew Sollars said the contribution limit ?reduces the influence of deep-pocketed special interests and keeps corporate money out of our elections.?

?Combined with the public matching funds . . . these limits ensure that candidates listen to the voices of all New Yorkers.?

(AP) ? Republican opponents are sending signals that Chuck Hagel's bid to become defense secretary will probably come to an up-or-down vote soon in the Senate.

That's unless more information damaging to the nominee ? and the Obama administration ? surfaces in the coming week.

Critics maintain the decorated Vietnam combat veteran and former senator is unqualified to lead the U.S. military. A top White House official expressed "grave concern" over the delayed confirmation vote, adding that there was nothing to worry about in any disclosures that may yet come.

Arizona Sen. John McCain, a key Republican on defense matters, said Sunday that he doesn't believe Hagel, a one-time colleague and friend, is qualified. "But I don't believe that we should hold up his nomination any further, because I think it's (been) a reasonable amount of time to have questions answered."

McCain and other Republicans angered President Barack Obama by delaying a vote on Hagel last week and preventing him from rounding out his second-term national security team, which includes Hagel and John Brennan, the White House counterterrorism adviser who is awaiting confirmation to become CIA director. Former Massachusetts Sen. John Kerry assumed his post as secretary of state at the beginning of February.

Critics say Hagel, who snubbed McCain by staying neutral in the 2008 presidential race between McCain and Obama, isn't supportive enough of U.S. ally Israel and is unreasonably sympathetic to Iran, which has defied international pressure to halt its pursuit of material that could be used to make nuclear weapons.

Hagel's nomination also became ensnared in Republican lawmakers' questioning of how the White House handled the September attack against a U.S. diplomatic mission in Benghazi, Libya, in which the U.S. ambassador and three other Americans were killed. Hagel had no role in the administration's response to the Benghazi attack.

GOP senators also have challenged Hagel's past statements and votes on nuclear weapons, and his criticism of President George W. Bush's administration.

Republicans last week delayed a confirmation vote, but have indicated that one will be allowed when lawmakers return from a break on Feb. 25.

Sen. Lindsey Graham, R-S.C., another leader of the opposition to Hagel, referred to a letter he received from Hagel in response to questions about past statements on Israel. Graham said that, as a result, he'll take Hagel at his word, "unless something new comes along."

Still, the weeklong delay buys Hagel's opponents more time to rally additional opposition.

White House chief of staff Denis McDonough, making his first appearances on the Sunday talk shows in his new role, was asked if the delays in filling out Obama's Cabinet presented a threat to national security.

"It's a grave concern," he said.

Hagel "has one thing in mind: How do we protect the country," McDonough said, adding that there was nothing to worry about in any disclosures about Hagel that may still come.

Graham said senators were taking seriously their responsibility to scrutinize "one of the most unqualified, radical choices for secretary of defense in a very long time."

Obama has criticized Republican senators for delaying the nomination, accusing them of playing politics with national security.

McDonough appeared on ABC's "This Week," while McCain spoke on NBC's "Meet the Press" and Graham was interviewed by "Fox News Sunday."

Je poss?de un Nexus 4 depuis environ une semaine et je me suis rendu compte que, contrairement ? mes anciens t?l?phones, je ne recois plus les MMS automatiquement si je n'ai pas la 3G activ?e.

Et comme j'ai un forfait free 2? +0.99? pour 20mo de data, j'active la 3G que occasionnellement...

Avant, j'avais un HTC Desire et HTC Desire X, et ca ne posait aucun soucis. Le t?l?phone activait automatiquement la 3G pour la r?ception ou l'envoi d'un MMS. (donc pas la peine de me r?pondre que c'est normal de ne pas recevoir les MMS si je n'active pas la 3G)

Mais d'apr?s mes essais et recherches sur le net, depuis la version ICS d'android, ce n'est plus le cas Sad

Donc, ? moins d'?tre Mme Soleil, pour pr?voir l'arriv?e d'un MMS et activ? la 3G juste avant, on ne peut plus recevoir de MMS, car la 3G n'est pas activ?e.
Pourquoi je n'active pas continuellement la 3G? Pour gagner en batterie et ?viter du hors forfait.

Bref, est ce que quelqu'un aurait une solution pour que la 3G s'active automatiquement lors de la r?ception d'un MMS?

Fugitive ex-Los Angeles cop believed killed in fire after shootout

ANGELUS OAKS, California (Reuters) - A former Los Angeles police officer linked to a killing spree targeting police and their families is believed to have died in a rural cabin that burned down around him in a fiery end to a massive California manhunt, authorities said on Wednesday.

Police were awaiting forensic analysis to confirm that charred remains found inside the cabin in the wooded hills of the San Bernardino National Forest were that of 33-year-old Christopher Dorner.

Authorities including Los Angeles Mayor Antonio Villaraigosa said the man who had barricaded himself inside the cabin was almost certainly Dorner.

"Almost everybody believes it is him, but at this point we're not absolutely sure," Villaraigosa told CNN.

"There's a sigh of relief," Villaraigosa said. He cautioned, however, that it could be "days, maybe even weeks" before there is final confirmation that Dorner was dead.

Dorner had been the subject of a six-day manhunt across southern California. He is believed to have made his last stand in the cabin, where a gun battle ended in the death of a sheriff's deputy and the wounding of another deputy.

Dorner is suspected of killing four people, including the deputy.

An angry manifesto posted last week on Dorner's Facebook page claimed that he had been wrongly dismissed from the Los Angeles Police Department in 2008. He vowed to seek revenge by unleashing "unconventional and asymmetrical warfare" on officers and their families.

The Los Angeles Times reported that Tuesday's climax to the manhunt began when two housekeepers encountered a man believed to have been Dorner inside a vacant cabin near the ski resort community of Big Bear Lake.

They surprised the suspected fugitive, who tied them up and then took off in a purple Nissan parked near the cabin.

One of the women freed herself and called 911, the newspaper reported.

CHASE TO THE FINAL STANDOFF

State game wardens spotted the vehicle and gave chase. The suspect crashed the car, then commandeered a pickup truck at gunpoint from another motorist, said Lieutenant Patrick Foy of the state Fish and Wildlife Department.

The suspect fired at the wardens from the window of the pickup and one of the wardens stopped his truck and returned fire with a high-powered rifle, Foy said. He said he did not know if the suspect had been hit.

Foy said officers got close enough during the chase to recognize the driver as Dorner before he abandoned the truck and fled into the woods to the cabin.

During a lull in the gunfire, the cabin caught fire and was quickly engulfed in flames.

Dorner's last confirmed encounter with authorities was on Thursday, when police said he ambushed two policemen at a traffic light in Riverside, about 60 miles east of Los Angeles. One officer was killed and the other wounded.

The former U.S. Navy officer is also suspected of having exchanged gunfire on Thursday with police in nearby Corona. One officer was wounded.

The hunt for Dorner began last Wednesday when police identified him as a suspect in the slayings of a campus security officer and his fiancee, the daughter of a retired Los Angeles police captain. In his manifesto on his Facebook page, Dorner blamed the captain for his dismissal from the LAPD.

Authorities posted a $1 million reward for information leading to Dorner's capture, an amount they said was the largest ever offered in a Southern California criminal investigation.

GOP warns Obama against tax increases, spending

WASHINGTON (AP) ? Republicans warned Tuesday that President Barack Obama's second-term agenda would bring more tax increases and escalate deficit spending, vowing that they would guard against Washington-centric policies and help middle-class families rebound from years of tepid economic growth.

Republicans responded to Obama's State of the Union address with fresh appeals to voters on the economy, promises to rein in federal spending and address the future of entitlement programs like Medicare. The party sought to portray itself as an alternative source of policies to grow the economy after the president swept to re-election last November.

Florida Sen. Marco Rubio, delivering the Republican response, urged Obama to "abandon his obsession with raising taxes" and said the president had shifted the nation away from free-market economic principles that had helped middle-class families achieve prosperity.

"Presidents in both parties ? from John F. Kennedy to Ronald Reagan ? have known that our free-enterprise economy is the source of our middle-class prosperity. But President Obama? He believes it's the cause of our problems," Rubio said.

Kentucky Sen. Rand Paul, in a separate tea party response, said both parties had failed voters by driving up trillion-dollar deficits. "Washington acts in a way that your family never could ? they spend money they do not have, they borrow from future generations, and then they blame each other for never fixing the problem," Paul said in prepared remarks.

Rubio appeared to wipe away sweat during his rebuttal from the Speaker's conference room in the U.S. Capitol. At one point, he reached out with his left hand and took a small swig from a Poland Spring water bottle. As the incident generated heavy attention on Twitter, Rubio later tweeted a photo of the water bottle.

Republicans sought to characterize Obama as overly reliant on government, even as the president made his case to the nation that he could generate new jobs without raising the federal deficit. Defending his policies against GOP critics, Obama said the nation needed a "smarter government" instead of a bigger one and pledged to increase federal spending to fix roads and bridges and boost the minimum wage.

Both Obama's address to Congress and the Republican responses around the Capitol sought to position each party as the champion of average Americans in a nation still grappling with high unemployment and a slow economic recovery. Republicans noted that the nation's jobless rate ticked up to 7.9 percent in January and the economy shrank at an annual rate of 0.1 percent in the final months of 2012.

House Speaker John Boehner, R-Ohio, said Obama offered the American people "little more than more of the same 'stimulus' policies that have failed to fix our economy and put Americans back to work. We cannot grow the middle class and foster job creation by growing government and raising taxes."

Ohio Sen. Rob Portman accused Obama of promoting "the same big-government policies that have failed to get our economy up and running again."

Rubio, a rising star in the Republican party and a potential 2016 presidential contender, pointed to his Miami roots to address Obama's frequent portrayal of Republican presidential candidate Mitt Romney ? and his party ? as only caring about the wealthiest Americans. Rubio said he still lived in the "same working-class neighborhood I grew up in" and his neighbors "aren't millionaires" but retirees, workers and immigrants.

"His favorite attack of all is that those who don't agree with him ? that we only care about rich people," Rubio said.

Rubio pre-recorded the same speech in Spanish for Spanish-language networks, a nod to Republicans who have said that they must address their deficit with Hispanic voters in order to compete effectively with Democrats in the future. Obama won 71 percent of Hispanics last year against Romney.
